Jammer perform successful apex passing several blockers. By the momentum jammer lose balanse and slide out side of the track going out of bounds. At this moment all blockers  are behind the jammer. Then jammer return to track in front of all blockers without attempt to cede. Cutting for the jammer or not?

If the loss of balance was caused by a block from an opponent then this opponent has superior position -> cutting
If the loss of balance was not caused by an opponent -> no call

The description sounds like the latter case.

A relevant question to ask is when does C4.40 come into play for the above scenario? *Assuming the loss of balance was not caused by an opponent.*

Restating the scenario: Rewritten Scenario to explain the above question: **edit for clarity**

-Jammer performs an apex passing several blockers, their foot lands first.
-The momentum jammer causes them to lose balance. The jammer slides across the track and slides out of bounds on the outside of the turn.
- At this moment all blockers are behind the jammer. The pack speeds up and the jammer chases the pack to return to track in front of all blockers.

Call: Red Jammer, Skating out of Bounds?

WFTDA Rule/Clarification:
Scenario C4.40

Red Jammer passes all members of the Pack except for White Pivot, who forces Red Jammer out of bounds to the outside of the track. While Red Jammer is out of bounds, the Pack skates counterclockwise ahead of Red Jammer. Red Jammer takes several skating strides while out of bounds, counterclockwise, to maintain their position ahead of the Pack and behind White Pivot, before returning in bounds.

Outcome: Red Jammer is penalized.

Rationale: Skaters are not allowed to accelerate or maintain speed while out of bounds, unless they are doing so to hasten their return to the track or entry to the penalty box.

Keep in Mind: Accelerating or maintaining speed while out of bounds in the clockwise direction should not be penalized, as it does not allow the out of bounds Skater to maintain their position relative to in bounds Skaters.

I would say no. C4.40 comes into play when you are using OOB to catch up to the pack instead of entering the track first. That doesn't seem to be happening in this example.

That doesn't seem to be happening in this example.

Perhaps I was unclear. I would agree no in the original but I modified  the scenario a touch.
I play devils advocate a lot, it is always because I desire a complete understanding of the rule/scenario. I do make changes to my reffing often as a direct result of discussions resulting in a consensus. Particularly if it is contrary to my previous understanding.

I would say no penalty in the original scenario. 

Yes penalty in Llama's modified scenario.  That is the pretty much the exact situation in C4.40
